Its been my experience that once you accept a check from an insurance company they usually consider their responsibility fulfilled. Good Luck...
2003 GL1800 Wing trike.Champ solid rear,35k miles
A month ago in Fl. on vacation a guy backs into our wing trike pushing it sideways in a VFW parking lot for the fish fry. The VF commander said he didn't know who, but I found out a week later from the tech guy who saw the video. He said they are friends and see him there almost daily. He's 85 and complained he was broke, so I said give me $100 for the air wings, I'll fix it Merry Christmas
I find later he gets 3 retirement checks, state etc.I drive over to meet and the commander said Im trying to take advantage and the guy was offering a check that I don't want out of town. I told the boss he was incompetent and it got weird when the commander said get out and don't come back. I didn't take the check
This moron VFW el capitan calls me a outsider trouble maker.
Im a VF life member/brother/dad,& brothers/Mothers brothers/G-Father & brothers,WW vets in bad places.
I turned it into his ins. co. The adjuster comes over and writes a check for $814 for plastic and referred me to a dealer to estimate front shake and pinched throttle cable. Now his ins co. wont pay for inspection of Head / fork/brgs, in the questionable area's to v-block inspect tubes, and look over the frame area's..Now the adjuster said If its smashed, they pay, but internal non obvious NO pay..3 mechanics said it shakes too much and its right to replace $39 brgs when the labor is 2.5 hours to service it.
Its a month since the hit and we towed this 1850 miles to ride here.
Have any of you had to fight for inspection time ?
Should they pay something for rental and loss of use ?
As part of the claim, the loose front and cables and anything else they find will be assessed later and submitted with the form.I dont want to make this messy with a lawyer over another $500
We love Fl but the place is dangerous and weird at times.
thats expected of the best place in winter I guess.
On the way to VF a corvet passes me tires spinning, then slides sideways while wide open and takes down an over hanging light pole. As I rode through a glass shower I wonder where the pole is landing. The vet was 4 days old. Every year we see strange things here, like being forced against the guard rail twice in a week last year. And the closest call this year was walking on a dark street at night when we almost got killed by a drunk or texter.
Biker travelers beware of some shops and stalling ins. co's.

If "Plan A" didn't work.
The alphabet has 25 more letters!

1st, did you take the check for $100.00 if not good. His insurance company could have used that as a settlement payment. (legally)
Get your bike fixed, gather all your bills, and loss of use damages, get a lawyer, and sue the guy, the VFW, and the insurance company.
and be sure to claim your legal costs in the filing
Rake...
Never had it....
Never will...
A friend of ours has a 3 year old wing with Hanagan trike kit. They were hit by someone last summer and the trike was totaled. The offenders insurance company is offering to pay the value of the wing as a two wheeler but not the trike since it's an aftermarket item and not OEM. The trike was right at $40k new but he's being offered less than $15k by the insurance company. So far, he's not accepted the settlement and has hired a lawyer.
It depends as what it was insured as. If it's described as a converstion on his policy, then he has a case. Even if the insurers inspecter sees it only as a 2 wheeler, the victim should get paid by his co. And his insurance co. gets reimbursed by the hitters co. Most insurance co.s want you to do the work. But if ya threaten them, they will change there tune. That's what a good insurance co. does.
if it's a conversion and the vic did not change it on his policy, then good luck.

+3k extra's. 23k or 29k about same price. Will reduce with miles.
Pics and details help to show your not too over insured.
The adjuster and more so his boss spend all the time trying to cheat you.
After almost letting old charlie off the hook for $100
It cost His ins. co. $2000
It wasn't worth the stress though. like the old saying..
You can get what you want or just get old. All these things drag you down.
I wanted to bike down here, but worse I wanted to bike in PVR Mexico too.
Looking back the near death experiences down there were closer than here.
Thats another thread
Safe travels too you
I want to pass on like my Grampa, At peace with a smile on his face and leaving all worries behind as he drifted away..
Not like his screaming passengers.
