    Default Texas Open Carry

    Now that Texas has open carry I think this would be appropriate ... except at Waco.

    Found this on TrikeTalk in 2012 before Texas started open carry.

    I'd agree, might bite into your legs and you's have to be diligent about not leaving it there when you leave the bike. I can't imagine the guilt trip I could put myself on if I forgot to take it and some kid played with it and shot someone, or himself. I hate that I have a logical mind and must take thoughts to a logical conclusion.

    Fuzzy, Fuzzy .... this is Texas humor. We all grew up with guns in Texas and nobody "shot their eye out". But you are probably right -- kids don't have the horse sense anymore that we did as kids and sure enough somebody would get hurt if this were a real gun and the kids were left unmonitored.

    On the other hand....it would be fun to see Candid Camera shots of people's reactions and comments as they walked by.

    Even with the new Texas Open Carry law this set up would be illegal. The law states shoulder holster or on the belt holster. I have one of those steering column holsters that NRA sells and a LEO buddy I rider with said as nice as it looks, it's illegal. Also have a very nice leg holster my Grandpaw use to wear. Same story illegal.

    So this bike set up would bring you some unwanted attention, as nice as it looks. There is also an issue to child accessibility laws. But it does look nice.

    You need to check with someone else! I don't believe the steering column holster is illegal

    Hey Carla, I came across a similar holster set up on a custom Indian back a couple of years ago. While looking at it the owner stated that it was just for show... movie prop from back in a day. It looked so real!

    Talked to a DPS officer this weekend who happened to be eating where we stopped to eat. Ask him about the steering column holster. He said if you can see the weapon it's illegal. If I cover it with something no problem. I said something about open carry. He ask if it was on my belt or shoulder ??

    Found in the Texas fire arms laws, may be carried in a vehicle but, must not be in plain sight.

    So, it becomes a question of if a steering column holster, under the column, would be considered plain sight or not.

    If it can see easily seen by looking into a vehicle window, open or closed, I guess it would be considered plain sight and therefore be illegal.

    Don't you just love the little traps laws leave. Just what part of "open" don't these law makers get? If you can carry "open" on your hip, just how does carrying "open" in or on your car dash become so different? They are just traps as far as I'm concerned. I'd think a cop would much prefer to SEE a gun rather than have one hidden that you can reach. But then I don't go around stopping people on the roads and come up to their car window to ask them if they know why they got stopped. I know that's a big risk but to me, I'd rather see the gun so I could tell that person if they make one single move to get it they'll be dead. So obviously I don't get why hiding the gun is better. I won't open carry anyway so I don't have to worry about all the traps. It just seems dumb to me.

    I agree hogcowboy! Would be interesting for a trial case of an arrest for a "unhidden" weapon in a vehicle, now that there is a open carry law!

    I would never open carry either, My reason is because a shooter looking to kill is going to go for those w/visible arms first!

    This is probably what you read:

    (f)It is not a defense to prosecution under this section that the handgun was carried in a shoulder or belt holster. SECTION 45. Section 46.02(a-1), Penal Code, is amended to read as follows:

    (a-1) person commits an offense if the personintentionally, knowingly, or recklessly carries on or about his orher person a handgun in a motor vehicle or watercraft that is owned by the person or under the person ’s control at any time in which:

    (1) the handgun is in plain view, unless the person is licensed to carry a handgun under Sub-chapter H, Chapter 411,Government Code, and the handgun is carried in a shoulder or belt holster;

    You mean they've been lying when they say a visible weapon would scare the bad guys away. You just can't trust nobody anymore.

    Jim...my take is, as long as it is totally concealed from sight in your right front pocket or anywhere else on your person and you have a CHL you are ok. However, if even the butt of the gun is protruding out of your pocket or from wherever else it is secured, and is in plain sight, then evidently a LEO could snag you if he wanted to because: you are not totally concealing the gun from sight AND not properly holstering it in plain sight. They have REALLY mucked-up the laws - as usual.

    I guess they want the openly carried gun to be difficult to get to so that a person is not carrying it around in just his hand - subjecting to accidentally dropping it, or, as a cell phone, placing it down somewhere and therefore not in control of it, or alarming people to see someone "brandishing" a gun. So, outside holster carry might be a good idea from that standpoint.

    They should:

    Stop this nonsense of whether it is concealed or not - that point is now moot - now that open-carry is allowed.

    As such, they need to change the name from CHL (CONCEALED Handgun License) to LTC (LICENSE To Carry).

    Unconcealed, in your car, and therefore subject to arrest? Don't see how that is possible now with open-carry and it being on or about your personal property and your having a permit. Think I would call the NRA and get their lawyers involved.



    It's never been a worry for us - just put it in the deep right front pants pocket and go about your business...

    If you can see the weapon, no it is not legal. Just going by the law.

    out of sight.because alot of places started to ban open carry, it scared people.you can ccw but not open carry.same here in oklahoma.better to carry concealed,the left dont get so upset.also bad guys dont know who has a gun.

    I was walking in a flea market type place several months ago and was pulled to the side by a cop. I was carrying with a shoulder holster covered with a vest. As the cop was walking to my left, apparently he could see my holster which is a cross-draw holster. I don't know if he was just being a jerk or not but he claimed he could ticket me as I wasn't carrying legally for conceal carry or open carry. I said I thought the new Texas open carry law would allow for some degree of inadvertent exposure. The gun could not be seen, just the holster and shoulder strap. So without a doubt there are some cops looking for anything. I think my Barney Fife needs to loosen up some but trust me, you got to still be very careful carrying.
