I'm going to say yes since harley doesn't do it, it is a after market thing and since it is after market I would say yes, but have been wrong before, I'm sure the EPA wouldn't want it either, I guess it depends on your dealer also, if you have a good one maybe not, if traveling you might be up the creek without a paddle.
Waiting for Kevin to chime in on this since he sells them and few company's do also.

On my 2017 Freewheeler, I installed an external breather system of my own design & a K&N air filter in the stock box. I saw an immediate improvement in performance.
If I had it to do over I would go with 1 of DK Customs air cleaner systems, but I am happy with what I have. I would also highly recommend the Thundervolt 50 spark plug wires that DK Customs sells, they are a great improvement.

Mark, yes an EBS is needed on Harley engines to keep the oily hot mess out of the throttle body and combustion chambers. It will prolong your engine while keeping the oily mess from forming carbon deposits on top of your pistons. This over time can slowly change your compression ratio and also cause detonation in the combustion chambers. Is it going to work against your warranty? Only HD can fully answer that.IMO. Trampas, I think you would be correct. For most of the ESP contracts that I have read, I would be very leery that those insurance companies would find a way to get out of paying a claim if something happened to the engine after certain modifications have been made to a bike. Seems like they use the term must be OEM approved and/or installed. I know it really gets murky with these ESP companies. I guess one would just have to ask the company straight up if it would void the ESP contract. For now, I still have another 14 months before the OEM warranty runs out. So time to think about it.
Can you change to a ebs air cleaner without having the bike retuned?, would love to add a high flow air cleaner to my trike. Thanks all

They are not necessary, but your engine will run stronger and longer with one. Here is what the inside of an engine looks like when feeding that hot, oily, oxygen depleted air back into the intake-

Regarding what to use, it all depends on what air cleaner you run with, but here is LINK with options for every A/C out there.

Any change to the engine, that is not a Harley/EPA approved part, will void the OEM powertrain warranty on a 2017 and up Harley. This did not use to be the case. But in 2017 Harley and the EPA entered into an agreement that violates the consumer protection act. Not worth it to fight their illegal agreement.
There are two options to not having your freedom stifled by them-
1. Simply remove the EBS before taking your Trike into Harley (should that need every arise).
2. Get a real warranty (that runs concurrent with the 2 year OEM) that not only will cover the powertrain if you do mods to it, it will actually cover the Non-HD parts also. It can be had from the company at this LINK.
